T E R M S & C O N D I T I O N S
Term
Tour members – Person that purchased or taken up the packages, tours from the company.
Participants – Person that participate in all types of program from the company.
Sales / Agents - Person that representing the company and called “Organizers”
Condition
Tour members are deemed to have read understood and accepted the following: -
A) Tour Package
1. Tour package that offer from this web are subject to change without prior notice.
2. Please read the package carefully and the non mentioned items are not included.
3. Hotel room are base on TWIN / TRIPLE share basis by default.
4. Child fare is based on the child as third person in TWIN or DOUBLE room of which no extra bed for the child. If a child occupies a half TWIN, surcharge applied.
5. For student, rate quoted is based on quad sharing in a standard twin room without extra bed. (Quad sharing is allowed on certain tour packages only)
6. All meals, sightseeing and other terms as specified in the itinerary.
7. Departure by air, portage of one luggage not exceeding 20 kilo per person unless permitted by airlines.
8. Tour fare exclude visa fees, expenses on purely personal nature such as laundry, telephone calls, excess baggage charges, beverages, personal and baggage insurance, gratuities to drivers and escorts, optional tours.
9. No refund or reduction will be made to any person or individual who does not participate in or who forgoes any sightseeing tour, transfer or accommodation so provided at any time during the course of the tour, for whatever reason.
B) Payment
1. Deposit – 50% deposit per person MUST be paid upon confirmation and balance MUST be paid up 14 days prior to the date of departure. All deposits paid are non-refundable and non-transferable.
2. Cancellation – In the event of cancellation, cancellation fee will be applied base on the following schedule:-
a. More than 31 days: RM 300 or 30% of the tour fare/person. Whichever is higher
b. 16 – 30 days : RM 500 or 50% of the tour fare/person. Whichever is higher
c. Below 16 days : No Refund
3. Administrative fee of RM 100 – RM 800 per transaction / person will be incurred for changes, amendments made.
C) Safety
1. All tours and team building packages are exclusive of travel insurance. Risk is at tour members / participants’ responsibility. We do sell the insurance at extra charges unless stated in the tour packages. Organizer strongly encourages tour members and participants to buy travel insurance on their own.
2. No legal action or blame towards company in the events of any accidents happened as the company has taken proper procedure in organizing the tour.
D) Other concern
1. MEALS – As specified in the itinerary, other specified meals if available can be provided at extra charge. Appropriate meals for Muslim and Vegetarians passengers can be arrange on request basis subjected to the availability.
2. PASSPORT – All passengers must be personally ensured that their passport be valid for at least 6 month from the date of their returning to Malaysia.
3. TICKET – The tickets issued are special tickets restricted to certain designated airlines only. They are “non–endorseable”, non – transferable, non re-routable.
4. VISA APPLICATION – All passengers are encouraged to process their own visa. The organizer offers assistance but approval is not guaranteed. The organizer cannot be held liable for any loss of passport(s) due to any reason whatsoever including without limitations, negligence on the part of our employees, agents and / or servants.
5. EXTENSION STAY – Extension of stay after the end of the tour is subject to the tickets and seats availability. Extension of stay / deviation will be at passenger’s own expenses and no transfer will be provided to the airport for the returning flight. When extension of stay / deviation can not be confirmed prior to group’s departure, passenger is deemed to be taking the original tour schedule.
6. CHANGE OF ITINERARY – The organizers and its authorized agents reserve the right to change the itinerary with or without notice due to operational reasons.
7. TOUR CANCELLATION – The organizers reserves the right to change, postpone or cancel any tour prior to departure for any reason whatsoever including insufficient group size. Should this happen, the entire payment will be refunded without any obligation on the part of the company. In which event no liabilities whatsoever shall be borne by the organizers in respect of such cancellations.
8. GROUP TOUR HANDLING – The organizers endeavours to provide exclusive ground handling on all transportation and sightseeing services. However, tour members may be placed on seat – in – coach basis where necessary due to insufficient group size.
9. TOUR LEADER – This will only arrange for a group of minimum 16 adult passengers.
10. TOUR GUIDE – In the event of domestic tour, local tour guide will be provided if excursion coach is used.
11. COOPERATION – Should there be difficult and uncooperative Tour Members during the tour, whose act and conduct deem to be unreasonable and detrimental to the enjoyment, interest, well – being and safety of he other Tour Members and the smooth running of the tour in general. The tour leader concerned possesses full discretion to deal with such persons as he / she deems fit, including requiring him / her to leave the tour. The decision of the tour leader in this respect is final and conclusive and the Company shall not make refund for any uncompleted part of the tour.
12. RESPONSIBILITY – The organizers and / or its authorized Agents acts only as agents for the transportation companies, hotel and other participants in the program. Tickets, documents, notice letters and other Correspondence are issued subject to the terms and conditions contained in the contracts under which the participants provide the services. The organizers and its transportation company, hotel and other
participants in this programmed shall not be held responsible to any passengers for any loss, damages resulting from death or personal injuries, expenses, penalties or any other inconvenience of whatever nature and however caused or arising from the following: -
a) Any mistakes, errors, inaccuracy, wrong description, changes, alteration or amendment to any tour schedule or the itinerary whether material or otherwise.
b) Any additional expenses or costs incurred by the passengers due to delays caused by changes in the flight schedules or any other travel schedules, sickness, weather conditions, strikes, riots, fire, floods, commotion, war, quarantine and any other causes beyond the control of the organizers, its authorized agents and the other participants in the program.
c) Loss or damage of baggage and personal effects during the journey or on transit or in the event of an accident save if the same were cause by any acts of negligence or wilful neglect attributable to the company and / or its authorized agents.
d) Any abrupt termination of service by transportation companies, hotels and other participants in this program due to bankruptcy, liquidation, closure or suspension of business or any other so ordered by the authorities.
e) Any alteration on the routing or change of date of travel by passengers is solely at his / her own risk. The organizers shall not be held responsible for any inconvenience caused and extra expenses incurred.
f) The organizers shall not be held responsible for deportation or refusal of entry by immigration Authorities to / of tour members resulting from the possession of unlawful items of holding improper travel documents or other causes of whose behaviour and activities are considered as subversive by the foreign government concerned. There is absolutely no refund to tour member who had been refused entry.
13. The organizers reserves the right to adjust the cost of packages price due to currency fluctuations or increase in air, rail, road or ferry transportation, international airport taxes and fuel surcharges after acceptance ofa booking up to and including the date of departure.
14. The organizer reserves the right to cancel the tour due to any act of God, War, Strike, Riot or order from the Government of Malaysia, which is beyond its control. The organizer shall recommend alternative tours preferably to the same destination or other tours. Should any passenger decide not to accept the alternative tours, all moneys paid less the administrative fee chargeable will be refunded to the passenger.
15. In the event of cancellation by the organizer due to inability to secure seats or accommodation, the company will refunded the amount of money paid and the following compensation will imposed (B2).
16. Tour payments are based on cash terms, payment by credit cards are subjected to surcharges.
17. Unless specified, all tour rate quoted is based on non-commissionable and no complimentary seats to be given.
18. Every package offered contains different things that are inclusive and exclusive. Please refer to tour itinerary for details.
E) Student Group
1. For student tour, the tour manager and accompanied teachers will try its best to take good care of the students. School and the organizers held no responsibility to any incident happen beyond their control.
2. The students will be allocated in QUAD share by default and teachers will be in TWIN share.
3. Each group of 10 students (Primary School) and 20 students (Secondary School) will be accompanied by 1 teacher.
4. An approval letter from Ministry of Education MUST be presented before the tour. The application of the letter is the duty of the school.
